Terms of Service

By creating an account or otherwise using Sprk (the 'Service'), you agree to be bound by these Terms.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service. By creating an account, you warrant that you meet this requirement.

If you do not agree to these Terms, do not use the Service.

The App is for personal and non-commercial use.

You agree not to engage in any prohibited conduct, including the activities listed below.

Sprk is intended for conversation practice and fictional interactive experiences. The Service does not support pornographic, sexually explicit, exploitative, or unlawful content. Users may not use Sprk to generate or request such content.

All Sprk characters are fictional. Characters must not impersonate real individuals.

The App generates content using artificial intelligence. You acknowledge that such content may not always be accurate or appropriate, and may be biased, incomplete, or otherwise inappropriate. AI-generated content does not represent the views of Sprk.

AI-generated content is not a substitute for professional advice. Do not rely on it for medical, mental-health, legal, financial, or safety-critical decisions.

Sprk is not a crisis-intervention service. If you or someone you know is experiencing a mental-health crisis, contact local emergency services or a qualified professional immediately.

The App, including its software, design, branding, trademarks, logos, and materials provided by Sprk, is owned by Sprk or its licensors and is protected by applicable intellectual-property laws. You may not copy, sell, distribute, or use these materials except as allowed by these Terms or with prior written permission.

Subject to these Terms, Sprk grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal and non-commercial purposes.

Rights in AI-generated content may vary under applicable law. Nothing in these Terms gives you ownership of Sprk's software, branding, systems, or underlying AI models.

Use on iOS is also subject to Apple's standard EULA. Use on Android is also subject to the Google Play Terms of Service.

You keep any ownership rights you have in content that you upload or submit to the App. You confirm that you own the content or have all permissions needed to submit and use it.

By submitting content, you grant Sprk a worldwide, non-exclusive, royalty-free, and sublicensable license to host, store, reproduce, process, modify for technical purposes, transmit, and display that content only as needed to provide, secure, maintain, support, and improve the App. Sprk may sublicense these rights only to service providers that help operate the App.

You represent and warrant that your content and its use through the App do not violate any law, privacy right, intellectual-property right, or other third-party right.

This license ends when your content is deleted, except where limited copies must be kept for backups, legal duties, billing, security, fraud prevention, or enforcement.

Certain features require credits, purchased through a third-party payment processor.

Prices may change before purchase. All purchases are final and non-refundable, except where required by law or as set out in our Refund & Cancellation policy.

Credits are a digital product, hold no monetary value, and are non-transferable.

We may suspend or terminate your account, and remove content, at any time and without notice, for any violation of these Terms.

Enforcement may include deduction of in-app credits or permanent termination of your account.

The Service is provided 'as is' and 'as available', without warranties of any kind, express or implied.

To the maximum extent permitted by law, Sprk shall not be liable for any damages, including loss of data, profit, or any emotional or psychological harm, arising from your use of the Service.

We may modify these Terms at any time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
